The website is operated by Mend Housing (“Mend Housing,” “we,” “us,” or “our”). By accessing the website, submitting an inquiry, or communicating with us through the website, you acknowledge that you have read and agree to these Terms.

If you do not agree with these Terms, please do not use the website.

1. Purpose of the Website

Mend Housing is a real estate investment and development company focused on identifying, acquiring, improving, developing, and supporting properties and housing opportunities.

The website may provide information concerning:

  • Property acquisitions and sales;
  • Land and redevelopment opportunities;
  • Real estate development;
  • Investment or lending opportunities;
  • Housing and shared-housing opportunities;

2. No Obligation or Guaranteed Transaction

Submitting a form, requesting information, discussing a property, or communicating with Mend Housing does not require:

  • A property owner to sell or lease a property;
  • Mend Housing to purchase, lease, develop, or accept a property;
  • An investor or lender to provide funding;
  • Mend Housing to accept an investment or financing proposal;
  • Mend Housing to provide housing or other services; or
  • Any party to enter into a transaction.

Any proposal, estimate, expression of interest, preliminary valuation, or discussion is nonbinding unless the applicable parties enter into a separate written agreement.

The terms of any property purchase, sale, lease, investment, development project, loan, partnership, or other transaction will be governed by the final written agreements signed by the parties. Those agreements will control if they conflict with information appearing on the website.

3. Mend Housing’s Role

Unless expressly stated otherwise in a separate written agreement, Mend Housing acts for its own account as a real estate investor, purchaser, property owner, developer, prospective tenant, housing provider, or project participant.

Use of the website does not create a:

  • Broker-client relationship;
  • Agency relationship;
  • Fiduciary relationship;
  • Attorney-client relationship;
  • Financial advisory relationship;
  • Partnership;
  • Joint venture;
  • Employment relationship; or
  • Landlord-tenant relationship.

An individual affiliated with Mend Housing may also hold a real estate license. Any brokerage services provided by a licensed individual will be offered separately through the individual’s sponsoring brokerage and will be governed by the appropriate brokerage agreements, notices, and disclosures.

Mend Housing does not represent you in a real estate transaction unless that representation is expressly established through a separate written agreement with an appropriately licensed brokerage.

4. Equitable Interests and Contract Assignments

In certain transactions, Mend Housing may acquire an option, purchase contract, or other equitable interest in real property.

Mend Housing may:

  • Purchase and take legal title to a property;
  • Exercise or sell an option;
  • Assign its interest in a purchase contract to another purchaser;
  • Partner with another investor, developer, or purchaser; or
  • Use another transaction structure permitted by applicable law.

When Mend Housing intends to sell an option or assign an interest in a real estate contract, Mend Housing will provide the written disclosures required by applicable law, including Texas Property Code § 5.0205 and Texas Occupations Code § 1101.0045.

An assignment may result in Mend Housing receiving an assignment fee or other compensation. The nature of Mend Housing’s interest and role will be disclosed as required before the applicable transaction is completed.

5. Property Information and Evaluations

Property values, repair estimates, redevelopment concepts, potential purchase prices, rental projections, financing scenarios, and other evaluations are estimates only.

They may be based on:

  • Information provided by a property owner;
  • Public records;
  • Comparable property information;
  • Market conditions;
  • Photographs or videos;
  • Preliminary inspections;
  • Contractor estimates;
  • Zoning or land-use information; and
  • Other information available at the time.

These estimates may change after an inspection, title review, survey, appraisal, environmental review, engineering review, financing review, or further due diligence.

Mend Housing does not guarantee the accuracy of preliminary estimates or that a particular property can be purchased, developed, financed, repaired, leased, or used for a particular purpose.

6. Investment and Lending Information

Information concerning investment, lending, development, or partnership opportunities is provided for discussion and informational purposes only.

Nothing on the website constitutes:

  • An offer to sell a security;
  • A solicitation to purchase a security;
  • Investment, accounting, tax, or financial advice;
  • A promise of profit, income, appreciation, or return;
  • A guarantee against loss; or
  • A commitment to accept funds from any person.

Submitting a housing inquiry does not guarantee acceptance, placement, availability, eligibility, or admission into a Mend Housing property or program.

Housing availability may depend on factors including:

  • Property requirements;
  • Program eligibility;
  • Safety considerations;
  • Applicable laws and regulations;
  • Funding;
  • Referral requirements; and
  • The needs and suitability of the prospective resident.

Any residency, tenancy, occupancy, or program relationship will be governed by a separate written agreement and applicable law.

Mend Housing is committed to complying with applicable fair housing and nondiscrimination requirements.

8. Information You Provide

You agree that information submitted through the website is accurate to the best of your knowledge.

You also represent that:

  • You are authorized to provide the information submitted;
  • You are authorized to provide the telephone number and email address submitted;
  • You have the authority to discuss the property identified in your inquiry;
  • Your submission does not violate another person’s rights;
  • You will not submit fraudulent, deceptive, unlawful, or misleading information; and
  • You will not use the website to impersonate another person.

You remain responsible for the content of your submissions.

Please do not submit Social Security numbers, banking credentials, account passwords, medical records, or other highly sensitive information through the website’s general contact forms.

You may unsubscribe from marketing emails by using the unsubscribe link provided in the email or by contacting us.

10. Independent Professional Advice

Nothing on the website constitutes legal, tax, accounting, financial, lending, engineering, environmental, zoning, construction, or other professional advice.

Before entering into a real estate or investment transaction, you should consider consulting your own:

  • Accountant or tax professional;
  • Financial adviser;
